Welcome to Chicago Mobility Rentals. By using our website, placing a reservation, or renting equipment from us, you agree to the following Terms & Conditions and Liability Waiver. Please read carefully before completing your booking.
1. Booking & Reservations
All bookings are subject to equipment availability. Reservations are not guaranteed until payment is successfully processed and confirmed by our team.
2. Rental Period
The rental period begins on the selected delivery or pickup date and ends on the scheduled return date. Late returns may result in additional rental fees.
Minimum rental periods may apply depending on the equipment selected and are displayed during checkout.
3. Payments
We accept secure online payments through approved payment processors. Full payment may be required at the time of booking unless otherwise agreed in writing.
Customers agree not to initiate fraudulent or unjustified chargebacks or payment disputes for valid rental charges.
4. Security Deposits
Certain rentals may require a refundable security deposit. Deposits may be used toward unpaid balances, damages, excessive cleaning, lost equipment, or late return fees.
5. Delivery & Pickup
We offer delivery and pickup services within selected service areas. Delivery and pickup times are estimates only and may vary due to traffic, weather, building access, or other circumstances beyond our control.
Customers are responsible for ensuring safe and reasonable access to the delivery location.
Failed delivery or pickup attempts due to customer unavailability may result in additional fees.
6. Customer Responsibilities
Customers agree to use all rented equipment safely, carefully, and only for its intended purpose.
Equipment may only be used by the customer or authorized users and may not be transferred, sub-rented, modified, or used for unlawful purposes.
Customers agree to follow all operating instructions provided by Chicago Mobility Rentals.
7. Battery Charging & Equipment Care
Customers are responsible for properly charging and maintaining the equipment during the rental period using only approved chargers and accessories.
Equipment should be protected from water, flooding, fire, theft, abuse, extreme weather, and unsafe terrain.
8. Damaged, Lost, or Stolen Equipment
Customers are financially responsible for equipment that is lost, stolen, damaged, abused, neglected, or improperly used during the rental period.
Repair or replacement costs may include parts, labor, cleaning, transportation, loss of rental income, and related expenses.
9. Return Condition
Equipment must be returned in substantially the same condition in which it was delivered, excluding normal wear and tear.
Additional cleaning or repair fees may apply for excessive dirt, smoke odors, pet damage, missing accessories, or other avoidable damage.
10. Cancellations & Refunds
Cancellation requests must be submitted prior to the scheduled delivery or pickup date.
Refund eligibility may vary depending on notice provided, reservation timing, delivery status, and payment processing fees.
Same-day cancellations or cancellations after delivery may be non-refundable.
11. Equipment Availability
While we strive to provide the exact model reserved, Chicago Mobility Rentals reserves the right to substitute equipment with a similar or upgraded model when necessary.
12. No Medical Advice
Chicago Mobility Rentals does not provide medical advice and does not guarantee that any equipment is appropriate for a customer’s medical condition or physical needs.
Customers should consult a licensed medical professional if they have questions regarding equipment suitability.
13. Limitation of Liability
To the fullest extent permitted by law, Chicago Mobility Rentals shall not be liable for any injuries, losses, damages, delays, missed events, property damage, lost profits, or other claims arising from the rental, delivery, setup, use, malfunction, or inability to use rented equipment.
14. Assumption of Risk & Liability Waiver
Customer understands and acknowledges that mobility scooters, wheelchairs, and related mobility equipment involve inherent risks, including but not limited to falls, tipping, collisions, mechanical malfunction, property damage, serious injury, or death.
By renting and using equipment from Chicago Mobility Rentals, the customer voluntarily assumes all risks associated with the use, transportation, operation, and possession of the rented equipment.
Customer agrees to operate the equipment safely and only under appropriate conditions.
To the fullest extent permitted under Illinois law, customer releases, waives, and discharges Chicago Mobility Rentals, its owners, employees, contractors, affiliates, and representatives from any and all claims, liabilities, damages, demands, costs, or expenses arising out of or related to the rental or use of the equipment, including claims involving personal injury, property damage, or wrongful death.
15. Indemnification
Customer agrees to indemnify, defend, and hold harmless Chicago Mobility Rentals from any claims, lawsuits, liabilities, damages, attorney fees, or expenses arising from the customer’s use, misuse, possession, transportation, or operation of rented equipment.
16. Website Information
We strive to keep all website information accurate and updated; however, pricing, inventory, specifications, promotions, and service availability may change without notice.
17. Privacy
Customer information is handled in accordance with our Privacy Policy and may be used for booking, delivery, payment processing, customer support, fraud prevention, and legal compliance purposes.
18. Governing Law
These Terms & Conditions shall be governed and interpreted in accordance with the laws of the State of Illinois.
19. Agreement Acceptance
By completing checkout, signing a rental agreement, accepting delivery, or using rented equipment, the customer confirms that they have read, understood, and agreed to these Terms & Conditions and Liability Waiver in full.
20. GPS in Terms
Renter acknowledges that the equipment is equipped with a GPS tracking device for recovery and fleet management purposes.
